By accessing or using Dialogate, you agree to these terms. If you do not agree, do not use the service. If you use Dialogate on behalf of an organization, you represent that you have authority to bind that organization.
Dialogate is a practice and coaching tool. We do not guarantee interviews, offers, compensation outcomes, or job placement. Results vary by role, market, experience level, preparation, and many other factors outside of our control.
Feedback and scoring are intended for practice and self-improvement. They are not professional career, legal, medical, or financial advice. Use your judgment and verify anything important independently.
All purchases are final and we do not offer refunds. If something is broken or you were charged in error, contact support and we will help resolve the issue.
If you are on a subscription plan, you can cancel at any time to prevent future charges. Cancellation does not retroactively refund past billing periods.
Some features may rely on device sensors (camera, microphone) and automated analysis. These signals can be imperfect and may be affected by lighting, background noise, camera angle, network conditions, and device performance. Treat scores as coaching signals, not objective truth.
The service, including the design, branding, and underlying software, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the service for your personal, non-commercial practice, subject to these terms.
Dialogate may rely on third-party services (for example, hosting, analytics, browser APIs, or other infrastructure). We are not responsible for third-party outages or issues. Your use of third-party services may be subject to their own terms.
To the fullest extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the service will be uninterrupted, error-free, secure, or that any results or feedback will be accurate, complete, or suitable for your specific situation.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or relating to your use of the service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless Dialogate and its owners, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the service, your violation of these terms, or your violation of any law or third-party rights.
If you have a dispute, contact us first and we will try to resolve it informally. If we cannot resolve it informally, you and Dialogate agree that disputes will be resolved through binding arbitration on an individual basis, and not in a class, consolidated, or representative action, to the fullest extent permitted by law.
Arbitration terms, venue, and governing law depend on your jurisdiction. For a production launch, have an attorney finalize this section for your state or country.
These terms are governed by the laws of the jurisdiction where Dialogate is based, without regard to conflict-of-law principles. Where arbitration is not permitted, you agree to submit to the exclusive jurisdiction of the courts in that jurisdiction, to the fullest extent permitted by law.
We may suspend or terminate access to the service at any time if we believe you violated these terms or if required for security, safety, or legal compliance.
We may update features, pricing, or these terms over time. When we make meaningful changes, we will try to reflect them in the Updates page.
